ADOPTED REGULATIONS
 

 

Below are a number of new Regulations in support of the new Constitution and Organisational Transformation Plan (OTP).  These include:

These documents are the culmination of consultation with members and discussion at Board level and will be reviewed annually at appropriate points in the Board Annual Agenda Plan.

There are a number of key points we wish to highlight within the Membership Fees Regulation:

1. As agreed, the total amount to be collected by levies will be based on an overall budget to be submitted for submissions (expected in September/October each year).  Given the effective date of the constitution submissions are not possible for this Fiscal Year. As explanation, the overall levy includes the following components:

  • the total value of the 2007 levy
  • financial responsibilities that were the domain of the Regional Associations under the previous structure. E.g. the Travel Fund, Gymsport Officers expenses, National Championships judging and officials’ travel and accommodation costs
  • expenses required to operate the new structure - convening Sport Development Committees, Advisory Groups and Regional Boards, additional AGM, Summit and administration costs

2. As the budgeting and membership category fees are based on historical (and largely unverified) membership numbers there is a possibility that data could create a shortfall or excess of fees.  We will watch this closely through the first two quarters and advise accordingly if any adjustments are warranted to reach the planned budget.

3. The Board has considered the difficulty for smaller clubs in covering the fixed component of the membership fee.  We have spread this fee quarterly to ease cash flow issues.

4. We are planning to assess membership numbers on a quarterly basis but the Constitution only permits us to collect this data twice per year (see excerpt below from Clause 5.4 of the Constitution).

   “Club Register of Members and Participants: Each Member Club shall maintain a register of its members in the format determined by the Board. Each Member Club shall submit to GymSports NZ by 30 April and 31 October in each year, the names and category of membership of each member who is registered with the Club as at 31 March and 30 September.”  

We will submit a ballot to change the Constitution on this point to permit collection of information quarterly.  We expect the planned Database will facilitate the collection of this information.

5. Issues with the Regulations can be notified to the Board for consideration via the GymSports Officers, Transitional Board, CEO or Chair. Clause 5.5 of the Transition Regulations specifies the following restriction on members of the Inaugural Board

  “Any person who is appointed to an Inaugural Regional Board must relinquish any office bearing role they hold with a Regional Member in the Region with effect from 1 March 2008.”   

We appreciate the pressure this may be putting on the formation of Boards in some areas and we are prepared to relax this requirement.  Please advise The GymSports Officers if a sitting member of the current Regional Committees intends to sit on the Inaugural Board at the same time.

There will be some fine tuning required this year as we undertake the implementation process for our new governance structure.  Feedback is necessary and welcome during this process, we appreciate the input received to date – keep it coming.

The Board looks forward to the Leadership Forum next month as an opportunity to work with the expanded team to progress the OTP.
